Medical Marijuana and Medicaid/Insurance Generally

Does anyone have any insight on whether a Medicaid-enrolled physician can bill Medicaid for the evaluation of a patient that results in a recommendation for medical marijuana pursuant to a state's MMJ program? I know some states, like NY, have addressed the issue but others remain silent so physicians are worried about submitting an E/M claim, being paid, being audited, and having funds recouped due to the plan of care stating "recommendation for medical marijuana given." I am familiar with many of the legal nuances at play here but practically speaking, need guidance how physicians have handled this and how insurance companies have dealt with these claims. Please email me with information, if you have it! bhiggins@fbtlaw.com
